Circular on Preliminary Investigation, Supervision and Inspection of Soil Pollution in Construction Land issued by Chongqing Bureau of Eco-Environment

In order to strengthen the supervision and management of the quality of preliminary investigation of soil pollution in construction land, guide the investigation units, testing units and other practitioners to do a good job of process quality control, According to the Guidelines for Preliminary Investigation, Supervision and Inspection of Soil Pollution in Construction Land (Trial) and the Announcement of Technical Provisions on Quality Control of Soil Pollution in Construction Land Investigation (Trial) (Ministry of Ecology and Environment Announcement No. 17, 2022) of the Ministry of Ecology and Environment, the relevant work requirements are hereby notified as follows. Please make good implementation according to the actual situation.

1. The Eco-environment bureau of each district or county (autonomous county) shall organize supervision and inspection of the sampling and analysis work plan, on-site sampling, laboratory testing and analysis of the preliminary investigation of soil pollution in the construction land within its administrative area. 100% of the land within the scope of mandatory inspection shall be inspected, and the proportion of land outside the scope of mandatory inspection shall be determined by each district or county (autonomous county). The units that undertake more local investigation projects, have a low one-time passing rate of investigation reports, have failed to pass the review of supervision and inspection in the previous year, and have found that there are major problems with the results of investigation reports through sampling and retesting shall focus on random inspection.

2. The Eco-environment bureau of each district or county (autonomous county) may entrust a third-party professional institution or organize experts on its own to carry out supervision and inspection. During the contract period, the third-party professional institutions participating in the supervision and inspection shall not undertake or participate in the soil pollution investigation projects within the administrative region, or provide sample analysis and testing and other related services for the investigation projects. Experts who have interests related to the inspected object should take the initiative to withdraw, be honest and self-disciplined.

3. In order to reduce the burden on enterprises, the district/county (autonomous county) Ecological environment Bureau may choose all or part of the links to carry out supervision and inspection according to the work needs. Supervision and inspection can be carried out in a combination of online and offline inspection. The funds required for supervision and inspection shall be included in the fiscal budget and shall not be transferred to the working units.

4. The units engaged in investigation and testing shall earnestly shoulder the main responsibility for quality control, strictly implement the Technical Regulations on Quality Control of Soil Pollution Investigation on Construction Land (Trial), implement the quality assurance and quality control measures for the whole process, and actively cooperate with the competent authorities in the on-going and post-operation supervision. The units listed in the object of supervision and inspection shall use the whole process of "National Contaminated Land Soil Environment Management Information System" and "Handheld Terminal Software for Quality Control of Soil Pollution Investigation of Construction Land" to fill in the sampling records, test data, internal quality control records and other information (see the attachment).

5. The ecological environment bureau of each district or county (autonomous county) shall include the quality assurance and quality control report prepared by the employer as an important part of the soil pollution investigation report into the scope of evaluation, and shall not pass the evaluation if serious quality problems exist and correction and review have not been completed. Negative typical cases found by supervision and inspection shall be notified, interviewed or criticized and educated, and publicized on the official website and the "Credit record system for the practice of units and individuals engaged in soil pollution risk control and rehabilitation of construction land".

Vi. Matters not covered herein shall be executed in accordance with the Guidelines for Preliminary Investigation, Supervision and Inspection of Soil Pollution in Construction Land (Trial), Technical Provisions on Quality Control of Investigation of Soil Pollution in Construction Land (Trial) and other laws, regulations and technical standards. The Municipal Bureau of Ecological Environment will organize a spot check on the preliminary investigation report of soil pollution status of construction land approved by various districts and counties (autonomous counties), and notify units with major problems.
